Oracle v. Google: Judge finds structure of Java APIs not copyrightable, renders jury infringement verdict moot

Thought the Oracle v. Google litigation fireworks were over? Well, if you weren't aware, during the copyright phase of the trial, the jury found that Google had infringed the structure, sequence and organization of Oracle's Java APIs. However, at the time, Judge Alsup had yet to evaluate the validity of Oracle's API copyright claims upon which that verdict was based. Today, Alsup found that Oracle's argument didn't hold water because it would expand the breadth of copyright holder's rights too far -- in essence, it would allow owners of software code to prevent others from writing different versions to perform the same functions. This ruling renders the jury's earlier infringement verdict moot, and gives Mountain View yet another courtroom victory. Despite this latest defeat, Oracle's sure to run the case up one more rung on the legal ladder, so let the countdown to the appeal begin.

What next for Romney? Undercut Obama, raise money

(AP) ? What's next for Mitt Romney? The Republican presidential nomination finally in hand, he will spend the next three months trying to undercut President Barack Obama on the economy while portraying himself as Mr. Fix It for a nation with stubbornly and painfully high unemployment.

Romney also faces key decisions between now and his acceptance of the party's nomination in late August in Florida: Where should he compete most aggressively? Who should be his running mate?

At the same time, he must dive anew into fundraising and work to win over voters who are distracted by their own summer plans and day-to-day pocketbook worries ? while withstanding Obama's attacks on his own claims as a jobs creator.

Not that Romney is publicly sweating the hurdles that come with being the little-known challenger to a personally popular president.

"People will get to know me better," Romney told Fox News in an interview that aired Wednesday, the day after he sealed the GOP nomination with his primary election victory in Texas. He says the general election campaign is only beginning even though his chief challenger dropped out more than six weeks ago.

With a smile, he said of the voters, "My guess is they're going to get to know more about me than they'd like to by the time we're finished."

As if on cue, Obama's campaign opened a fresh critique of the GOP nominee-in-waiting, assailing his economic record as governor of Massachusetts. It's the second phase of an effort by Obama to define Romney negatively in voters' eyes. The Democrat already has spent weeks hammering the Republican on his record at the private equity company he founded.

Obama himself made a courtesy call to Romney to congratulate him on his nomination victory. An Obama aide said the president told Romney in a brief and cordial chat that he looked forward to debating America's future with him.

Romney spent the day in California, plunging into a week filled with fundraisers and efforts to unite Republicans after a divisive primary season. Already he's proven adept at both, hauling in enough cash to cut into the advantage that Obama has while getting most of his former Republican rivals to close ranks around him.

Those efforts ? and the turning of his primary campaign into a general election operation ? have been his prime focus. He's making only a handful of public appearances for now, but aides say they expect the campaign to ramp up to a full sprint by July 4. Romney has said he plans to take a week off around the holiday, suggesting that may be the time when he makes final deliberations on whom to choose as his vice presidential nominee.

Little is known about just where in that process Romney may be, though there is no shortage of Republican rising stars informally auditioning for the role.

While work on that front is certainly going on behind the scenes, Romney's aides are spending this week publicly pressing anew a criticism that the candidate himself has been making for months against Obama. They're highlighting the hundreds of millions of dollars in economic stimulus money that the administration provided to Solyndra, the solar-energy company that went bankrupt and whose executives had contributed to Obama's campaign.

It is a sign of the overarching argument Romney will make against Obama in the coming weeks: that Obama's economic efforts have been politically motivated, have wasted taxpayer dollars and, ultimately, have failed.

The renewed Solyndra criticism is also an attempt to answer Obama's recent criticism ? in speeches and advertisements ? of Romney's tenure at the helm of Bain Capital. Obama has argued that Romney's time as a private equity executive before entering politics ? the basis for his campaign's claim that he's best suited to lead an economic recovery ? was aimed at enriching shareholders, not serving the public.

Romney largely survived that opening salvo, judging by early polls and interviews with both Republicans and Democrats.

National surveys show Obama either statistically tied with Romney or only slightly ahead of him. And polls in the most hotly contested states show Romney competitive with Obama.

"They haven't worked," GOP strategist Charlie Black, an informal Romney adviser, said of the Bain criticisms. "People are worried about the economy and jobs."

Democratic strategist Steve Elmendorf said too few voters had heard the argument.

"The reality is it's June," said Elmendorf. "To say the Bain argument has worked or not is ridiculously premature."

A handful of swing-voting states will be the most hard fought as Obama and Romney aggressively build get-out-the-vote organizations and air a flood of advertisements in their efforts to reach the 270 Electoral College votes needed to win the White House.

Across the country, Romney's campaign is going through growing pains as it seeks to turn a stripped-down primary operation into a full-scale general election campaign. Aides say offices will open and more staff will join the team, but they also say they don't anticipate being able to match the staffing levels of Obama, who has had teams in place for months in states like Florida and Ohio. The Republican National Committee also is in the midst of boosting its staffing to help Romney.

Already, Obama's and Romney's campaigns, as well as super PACs supporting and opposing each, have spent more than $80 million in advertising on the general election campaign through the month of June, according to ad-tracking reports provided to The Associated Press by Smart Media Group of Alexandria, Va.

Of that, Obama's campaign has spent $31 million-plus on TV ads in about 10 states. He's been on the air most heavily in Florida, Iowa, Ohio and Virginia, an indication of where his team may think the race will be won or lost. A Democratic-leaning super PAC also has been on the air to help him, though it's spent only about $6.3 million.

Romney himself has run ads in just five battleground states: Iowa, New Hampshire, North Carolina, Ohio and Virginia. But he's been significantly helped by pro-Romney outside groups, who have been on the air in several others ? most heavily in Florida, Ohio and Virginia.

Even so, Republican outfits, including Romney's campaign and supporting super PACS, have combined to spend about as much as Obama and his allies. And in the coming weeks, Romney plans to focus heavily on fundraising so that he'll be able to make strategic decisions about where to devote most of it state by state.

To that end, Romney is spending the week courting donors in California, starting Wednesday in Fresno, Bakersfield and in Hillsborough, a wealthy enclave just outside San Francisco.

He planned major fundraising events Thursday, Friday and Saturday in southern California. On Tuesday, Romney was in Las Vegas wooing Sheldon Adelson, the primary financing source of a group that backed Newt Gingrich's failed primary campaign. And Romney also attended a fundraiser hosted by Donald Trump.

Beryl set to dump rain, regain storm status

Tropical Depression Beryl is expected to dump a foot of rain in parts of the Southeast coast on Tuesday, a day after drenching areas and claiming the life of an 18-year-old who was swallowed up by a rogue wave.

Beryl is also expected to build up strength and "could regain tropical storm status" on Wednesday as it approaches South Carolina, the National Hurricane Center stated.

The body of Ritchy Dauphin washed ashore Tuesday morning, about 12 hours after he went missing in violent surf near Daytona Beach, Fla., NBC affiliate WESH-TV reported. Dauphin and a friend had ignored the rip tides and high surf.

"They were pretty far away," Tacorey Williams, one of Dauphin's friends, told WESH. "I don?t know how many feet, but they were above waist."

"He tried to help," she said of the friend with Dauphin, "but the wave pushed him (Dauphin) farther" out.

Beryl left little property damage after making landfall with 70 mph winds around midnight Sunday in Jacksonville, Fla.

But 20,000 customers remained without electricity in the city Monday evening.

Moreover, up to 10 inches of rain are expected from northern Florida to southeastern North Carolina on Tuesday. Some areas could see 15 inches.

By early Tuesday, Beryl, which had weakened to a tropical depression, had maximum sustained winds near 30 mph. It was centered about 10 miles northwest of Valdosta, Ga., and was moving north at about 2 mph.

A frontal system moving south from the Great Lakes is expected to cause the storm do a U-turn and push it back out to sea later in the week.

The Atlantic's six-month storm season officially begins Friday, but the season got off to an early start with Tropical Storm Alberto forming earlier this month off the coast of South Carolina.

Jacksonville, because of its location on an inward curve in the Florida coast, rarely takes a direct hit from a tropical storm or hurricane.

"I hope this is not a sign of things to come," said Sen. Bill Nelson, D-Fla. "Normally the hurricanes are forming out in the Atlantic and as they come toward the coast of the United States, the Gulfstream has a tendency to turn them north."

The rain was welcome on the Georgia coast for bringing some relief from persistent drought. According to the state climatologist's office, as of May 1, rainfall in Savannah was 15 inches below normal for the past 12 months.

Emergency officials said minor flooding was reported near the coast, but the ground was quickly soaking up the water. Winds had died down considerably.

"We've needed it for a long time," said Ray Parker, emergency management director for coastal McIntosh County south of Savannah, who said the worst damage came by trees falling on two homes overnight. "Most of it soaked right in before it had a chance to run off. It fell on an empty sponge."

Although many aesthetically influential office chairs emerged at the beginning of the 20th century, it was a bad time for body-conscious design. Frank Lloyd Wright, for example, crafted a number of impressive chairs, but like other chair-designing architects, he was less interested in matching the chair to the human body than to the surrounding d?cor. In a couple of instances, he did acknowledge human movement. The Larkin Office Building, which he designed in 1904, featured three-legged office chairs for typists. When the typist leaned forward, the chair tilted with her. When complaints emerged about what became known as ?the suicide chair??because of its frightening instability?Wright defended his design, claiming that it forced good posture. (According to Edward Tenner?s book, Our Own Devices, Wright attempted to install the same three-legged chair in the Johnson Wax building in 1939 but received so much resistance that he eventually added front legs.)

Robot on your shoulder keeps a friend (or parent) close

Ever feel like you have a little person on your shoulder keeping track of your every move, providing encouragement to keep up the good work or stop you from doing something bad?

That little person may soon be more than just your conscience; it could be a robot that provides real-time interaction between you and a remote friend (or parent) as you do what you do.

Imagine going on a trip, for example, and bringing along your best friend who?s stuck at home, or sticking a robot on your child?s shoulder to remotely chaperone a Friday night out.

The robot, known as the miniature humanoid, or MH-2, is under development at Yamagata University in Japan. It has head and body moves like a person. It even breathes like one.

The idea is that a person stands in front a TV screen or an immersive display with a sensor such as a Kinect. This person sees whatever the person with the robot sees.

?Meanwhile, the robot on your shoulder acts like an avatar, duplicating the speech and gestures of your friend right there for you to interact with directly,? IEEE reports in its Automation blog.?

For now, the robot is controlled by servos in a 22 pound backpack, which would make bringing along a friend for every moment of a trip quite cumbersome, as well as awkwardly geeky.

But when the telepresence technology catches up with the imagination as illustrated in the video clip below, this could serve to keep friends and family close when they physically far apart.

Charlize Theron on diaper duty: 'I love it!'

In the soon-to-be-released summer flick "Snow White and the Huntsman," actress Charlize Theron takes on the role of Queen Ravenna, the murderous stepmother to Kristen Stewart's not-so-simpering Snow White. In real life, Theron recently took on a very different mom role when she adopted her new son, Jackson. Theron stopped by TODAY Tuesday morning to dish about both parts.

As for that evil queen, early trailers revealed she's much darker than any version of the character that's made it to the big screen before, but Theron insists her Ravenna just goes back to the roots of the role.

"The original Brothers Grimm (story)?has very, very dark tones," she explained. "It's darker than where we went with it. ? I think that's the thing people are finding kind of a shock, because they think it's a girl's movie because it's a fairy tale. But it's really a kick-ass (film)."

It's also a film that Theron clearly takes pride in. But there's something else that she's even prouder of nowadays: How well she handles her favorite new-mom chore -- diaper duty.

Debt management services offered by certain companies help distressed debtors deal with their problems.? Counselors are sent to meet with the client debtors in order to study their respective situations.? The objective of the studies is to arrive at conclusions that would then become bases for the concrete steps to be taken in order to manage debts.? One of the key resolutions would certainly be to make the creditors agree to proposals that certain charges or fees are removed so that the value of the debts would become more manageable for the debtor.

In all the definitions mentioned here, it is obvious that debt management does not mean escaping from the obligation of repaying.? A debtor who implements this does not have any intention to free himself from his obligations to the creditor.? Just Great Bookselling: Bilbary's Simple Vision, Big Ambition ...

As he sees it, [Coates] is simply doing what he has done many times before ? building a bookshop.

LONDON: There is no one quite like the UK?s Tim Coates in the book industry. He has been a bookseller, an author, a library campaigner and a publisher. Now, with the launch of Bilbary.com ? the international e-bookstore and library that went live in the US in March and opens for business in the UK and Europe in June ? to that list must be added the description digital innovator, though Coates smiles at the suggestion. As he sees it, he is simply doing what he has done many times before ? building a bookshop.

Bilbary.com allows users to download titles to any device ? PCs, laptops, tablets, anything Android, Sony Readers, Nook, Kobo, even the Kindle, although Coates concedes that ?you have to be a little bit tecchie to make it work.? Currently, it has some 320,000 e-books from around 2,300 publishers ? chiefly academic houses, small presses and specialist publishers. But by the end of May a further 110,000 titles will have been added from the big six: Penguin, Macmillan, Random House, Hachette, Simon & Schuster and HarperCollins, and he has hopes for many, many more.

A Viable Alternative to Amazon

He has a simple, open access vision for the site, borne of frustration at the walled garden systems that are proliferating in the digital space. ?We want Bilbary to be a place that people who like reading, who love books, can come and find things and read them on whatever they have.?

Naturally, he wants the site to differentiate itself from Amazon ? a considerable challenge. Here he starts to sound both evangelical and frustrated. ?Amazon is not a site where you want to hang around. They?ve done a brilliant job in promoting Kindle ? they?ve made e-books a proper, viable proposition and they?ve forced publishers to act. But what they haven?t done is force backlist to emerge. We?re really only just getting started when it comes to e-books. A lot of what Amazon offers is self-published. You can find something to read, but the real quality is not there.

?So at Bilbary we have this relentless pursuit of content. We want to replicate the sort of quality and range you find in Foyles or a huge Barnes & Noble ? and the text of all our books will be searchable too. I?d say that at the moment, only 30% of a large, stockholding bookshop is available in digital format. There are vast riches out there. How many Penguins are there as e-books? There are only about 9,000. But how many Penguin titles have there ever been? So we?re speaking to them about Pelican, about the classic green crime?You can go to the big six publishers and it?s the same story.

?Publishers obsess about their front lists ? a certain author is about to publish their fourth novel or whatever. Then they let things go out of print and forget they ever had them. Publishers think their job is to keep publishing, but their job is also to sell what they?ve already published. Instead, they?re always looking for the next pot of gold.?

Publishers Blame Agents for Lack of E-books

He maintains that publishers blame the agents for the lack of digital titles. ?They say they haven?t been unable to negotiate a digital deal. Well, they should sort it out. If print is going to decline, if that industry is going to collapse, then let?s manage the transfer to digital properly. We need a massive digitisation programme. Publishers will say it is happening, but I?m saying to them ?where are the titles?? Why is so little Marquez available digitally, for example? I really don?t think we?ve got started yet.?

Bilbary will also carry reviews, as well as recommendations and comment from booksellers and teachers and experts in their field. It has a library which has a link on the homepage that takes browsers to an interactive illustration of an old, small town library. ?We want people to have fun here,? says Coates. ?This is somewhere they can go for a good rummage around, just as in a physical library. You enter through some swing doors and we?ll have things like a science room where you can see the books being converted into digital in pickle jars. We?ll even have a cat on the rocking chair outside. Jo Budler at the State Library of Kansas [which has recently signed a deal with Bilbary] said ?librarians have a great affinity with cats?.?

Users of the State Library of Kansas who do not want to wait for one of the handful of digital files provided by Overdrive are given the option to buy a title, with a percentage of the revenue going back to the library.

If he sounded critical of publishers above, it?s more a case of urging them to act on the treasures they have. In fact, he despairs at some of the animosity that is currently around. ?We want to be nice to publishers, not at war with them. Publishers produce absolutely wonderful material. There are people who say why do we need publishers, I can publish a book ? but they can?t. What they produce is awful. It?s just that at the moment, you have publishers at war with librarians over lending, and at war with agents over digitisation contracts. And everyone is at war with Amazon. That hostile world is awful.?

Bilbary has private backers, including John Bartle of advertising agency Bartle Bogle Hegarty and a staff of around 14, including representatives in Beijing, Delhi and the US. Its home is in London?s glorious Bedford Square in Bloomsbury, just along from agent Ed Victor?s office and directly opposite Bloomsbury Publishing. Occasionally, the sound of a cello can be heard from an adjacent room, which means Coates? younger son Oliver is practising. He?s a professional musician, artist-in-residence at the South Bank Centre and winner of the Royal Philarmonic Society?s Young Artist award earlier this month. Coates? other son, Sam, is Chief Political Correspondent of the Times.

A Long, Personal Commitment to Bookselling

At the age of 62 Coates is embarking on a big project at a time when many might feel like sitting back. Perhaps it?s a case of Yorkshire grit, as the English phrase has it, but this unusual figure is quite happy tackling new ventures, taking on new challenges.

The son of amateur musician parents ? his mother was a school teacher ? he grew up in Huddersfield and studied maths at Oxford, during which time he became active in musical theatre and composed. Classical music remains a passion today. After university, he joined WH Smith as Marketing Planning Manager, thus beginning his 40-odd years in the industry.

He ran the Smiths-owned Sherratt & Hughes chain of more upmarket bookshops, which was eventually subsumed into Waterstone?s where Coates was briefly MD. Disagreements between Waterstone?s shareholders and WH Smith shareholders led to his departure, with subsequent years seeing him establish Uncovered Editions, which published government reports unearthed in the archives, such as the Titanic enquiry.

Exploring these archives led him to Mary Cornwallis West, mistress of Edward VII, whose story he began writing for his own enjoyment. Bloomsbury heard about it and the house that is now his near neighbour published Patsy (her nickname) in 2003.

He combined these publishing and writing activities with a growing interest in the fate of the UK?s libraries, an interest that led him to some impassioned campaigning which gained him enemies and friends in equal measure. In more recent years he ran Baker and Taylor?s UK office for academic library supply.

E-Lending is a Mess, This May Be an Answer

The idea for Bilbary arose out of his involvement in libraries, with Coates seeing its model as a solution to the current mess that is e-lending. The last year has seen him visit the US frequently, speaking to publishers and librarians and getting his mind around the complexities of the US tax system.

He owns a Sony Reader, currently loaded with Henry James? Portrait of a Lady (?beautiful?) and he has a lifelong love of Josef Svorecky and other Eastern European writers. ?I do like Czech writers very much ? they are subversive in a way that English and Americans don?t quite know how to do.

People are watching Coates and Bilbary with interest. Publishers would all like to see a competitor to Amazon, but the Seattle giant is a mighty body to take on, with a name embedded in consumers? minds. And yet there was a time when Twitter was a start-up no-one had heard of.

Coates has taken the bold step of building Bilbary in public, ?so we can learn from people as we go along?. He is also not taking himself too seriously in the process. ?John Sargent at Macmillan in New York said to me. ?Well, this is different. I?m used to having fresh-faced MBA students come and tell me how they can save publishing ? I don?t usually see a grey-haired industry veteran from across the Atlantic??

Energy quest, China concern takes Prime Minister to Myanmar

Prime Minister Manmohan Singh departed on Sunday on a three-day visit to Myanmar that underscores India's quest for energy supplies and concerns about China's strong influence in the Southeast Asian country.

Singh said he hoped to focus on stronger trade and investment links,

development of border areas and improving connectivity between India and Myanmar.

India remains "committed to a close, cooperative and mutually beneficial partnership with the government and people of Myanmar," Singh said in a statement before leaving for Yangon, Myanmar's biggest city.

The visit highlights India's search for energy supplies to fuel its economic boom and concerns about China's influence in Myanmar, where the elected - but military-backed - government is opening up its economy for investment and trade.

In recent years, India has nervously watched Beijing's domination of Myanmar's oil and gas exploration projects. Hundreds of thousands of Chinese workers are in Myanmar working on infrastructure and other projects.

Indian officials, however, are loath to acknowledge that India's Myanmar policy is being driven by China's inroads there.

India wants to "secure a stronger and mutually beneficial relationship with a neighboring country that is integral to India's Look East policy," foreign secretary Ranjan Mathai told reporters on Friday.

India has adopted a Look East policy of engaging with southeast and east Asia, reaching out and deepening bilateral ties with Japan, South Korea, Vietnam and Indonesia among others in the region.

Singh's visit will be the first in 25 years by an Indian Prime Minister, although the two countries share a 1,600-kilometer (1,000-mile) land border, as well as a maritime border in the Bay of Bengal.

Myanmar, which was once known as Burma, had been an international pariah for decades under a military junta that quashed any hopes of democratic reform. A 2010 election, though, has lead to at least some reforms and a gradual opening up to the rest of the world.

The competition between India and China in Myanmar is expected to surface again when Myanmar begins auctioning new natural gas blocks, both offshore and onshore, in which Indian companies are expected to participate actively.

"It would be in Myanmar's interest to not put all its eggs in one basket," says Rajiv Bhatia, a former Indian ambassador to Myanmar, referring to China's overwhelming presence in Myanmar's oil and gas exploration sector.

Mathai said that during Singh's visit, the two countries are slated to start a bus link between Imphal, capital Manipur state, and Mandalay, Myanmar's second-largest city.

India also will announce the creation of an IT training institute, an agricultural research center and a rice research park in Myanmar, Mathai said.

Over decades of isolation by the West, China reached out to Myanmar, building billions of dollars in roads and gas pipelines in the impoverished country.

New Delhi too has offered Myanmar aid and assistance, but not on the same scale as China.

In recent years, India has offered around $800 million in credit to Myanmar to help develop infrastructure such as railways, roads and waterways.

New Delhi also is helping build a port in the coastal Myanmar city of Sittwe. That port, Indian officials hope, will act as a trade gateway between India's northeastern states and Southeast Asia.

Bilateral trade between India and Myanmar was around $1.2 billion in 2011. Both sides hope to push trade to $3 billion by 2015.

Singh's trip follows high level visits to India by Myanmar's reformist President Thein Sein in October and visits by the foreign ministers of the two countries.

In the 1980s and early '90s, India was a strong supporter of pro-democracy leader Aung San Suu Kyi in her fight against the country's military. Singh will meet with Suu Kyi on Tuesday.

Prime Minister Rajiv Gandhi visited Myanmar in 1987, the last visit by an Indian premier.

But in the mid-'90s, India changed tack to engage with the country's military junta, resisting pressures from the Western democracies that had imposed economic sanctions on Myanmar.

New Delhi insisted it had to follow a pragmatic policy, because it needed its neighbor's help to crack down on Indian rebels who had built hideouts in the jungles along the India-Myanmar border.

India also argued that Myanmar's military leaders could be nudged toward democracy only by engaging with them - not by isolating the impoverished nation.

Mathai said India also was opposed to the sanctions because Myanmar was a neighbor.

"When you are a neighboring country, you do not have the choice of a policy and engagement," Mathai said.

"You remain engaged irrespective of the situation."

In the past year, Myanmar's military leaders have freed thousands of political prisoners, eased limits on the press and launched a series of economic reform measures. The military-backed regime allowed Suu Kyi's political party to contest elections and ushered in an elected government.

In April, the European Union suspended most of its sanctions to reward Myanmar's political reforms, and the United States said this month that it would suspend a ban on American investment in the country.

Someone, somewhere in Microsoft HQ in Redmond must have uttered a maniacal, guttural laugh on learning the news that Google wanted to acquire Motorola Mobility for $12.5 billion. The deal has now been closed and effectively makes Google a hardware & device manufacturer.

Announced back in August 2011, the move shocked the mobile arena and caused many to question Google's commitment to the relatively open nature of Android. Motorola would still be running as a separate business and would remain an Android licensee but those calming statements didn't prevent Google's market capitalisation from falling by $5 billion on that fateful day.

It is worth looking closely at the blog post written by Larry Page, the CEO of Google, announcing the completion of the acquisition. There's no mention of Android as an ecosystem. The quintessence of the post can be resumed in a few words; Motorola will make better mobile devices and will bring more money to Google. Hardly something partners will be happy to hear.

The reason why Microsoft should be smirking is that Windows Phone has become defacto the only real and credible alternative mobile platform to Google's Android. And the way Google pimped up the Motorola acquisition could encourage Open Handset Alliance handset manufacturers (all the 22 of them at the time of writing) to consider Microsoft Windows Phone as a mobile ecosystem.

Even if Microsoft has struck a strategic partnership with Nokia, I do not believe that the former will give any special preferences to the latter, especially as Microsoft is trying to raise the profile of Windows Phone (which according to analyst firm NetMarketShare has a smaller footprint than Amazon's Kindle) and cannot afford to leave any potential partners out, however small they may be.

They will be responsible for coaching teachers on how to enhance the use of assessment and classroom data to guide instructional practices that result in student achievement gains while developing student, classroom, and school profiles.

Essential Duties and Responsibilities of an Amana Student Achievement Coach

  • This is an 11-month position.
  • Analyze student performance data to determine the professional practices necessary for improved learning.
  • Develop a coaching and support plan likely to improve teacher professional practices.
  • Present data showing the impact of the support plan on the teacher performance of professional practices.
  • Link changes in professional practices to improvements in student learning.
  • Work to provide training to teachers on development of quality formative assessments, and facilitates the administration of benchmark assessments in the areas of math, reading, writing, and science.
  • Research and provide information and guidance regarding a range of effective and innovative classroom standards-based practices, incorporating coaching sessions, demonstration lessons with pre- and post-discussion/analysis, staff meetings, professional development sessions, and instructional technology where appropriate through various activities such as individual discussions (informal and formal).
  • Visit classrooms on a routine basis, providing timely feedback.
  • Maintain paperwork consistently, appropriately and in a timely manner.
  • Maintain the confidentiality of schools, teachers, and classrooms.
  • Coordinate/facilitate instructional material pilots and implementations (including software).
  • Develop individual trainings for employees for the purposeof supporting supervisor-directed employee growth plans.
  • Facilitate a variety of meetings and activities (e.g. school-site meetings, trainings, team-building activities, etc.) for the purpose of presenting and disseminating necessary information for making decisions and increasing student achievement.
  • Meet twice a month with the Administration.
  • Instruct, advise, coach, and supervise extracurricular activities as defined by the Administration.
  • Perform other duties as assigned by the appropriate administrator.
  • Maintain meeting logs and evidence of progress toward established team goals.

Qualifications

  • Master?s degree, or higher in Education from an accredited institution (Curriculum & Instruction degree/experience preferred).
  • Certified teacher with a minimum 5 years? classroom experience (elementary/middle preferred).
  • Knowledge of project-based, standards-based educational approaches (Expeditionary Learning context preferred but not required).
  • Skilled and trained in computer hardware and software applications and possess the skills to train personnel in computer use.

Student Achievement Coach

  • Strong skill set with analyzing assessment data to uncover trends and opportunities.
  • Good writing and speaking skills.
  • Knowledge of the coaching cycle and ability to successfully coach teachers (experience with staff development implementation preferred).
  • Knowledge of the CCGPS, instruction and assessment as they relate to each other and influence student achievement.
  • Highly skilled at implementing exemplary educational practices resulting in demonstrated student achievement gains.
  • Ability to lead colleagues by utilizing effective communication and leadership skills.
  • Other alternatives to the above qualifications as the hiring committee may find appropriate and acceptable.
